Carry forward three things: a clear definition, the warning signs, and the reason construction is exposed. Modern slavery is not simply a hard or badly run job; it describes serious crimes and severe exploitation — forced labour, debt bondage, deceptive recruiting, human trafficking and slavery-like practices — in which coercion, deception and a genuine loss of freedom are present. Construction remains the sector to watch because it combines long and opaque supply chains, heavy reliance on imported materials and manufactured products, extensive use of labour hire and migrant labour, and relentless price competition, all of which give exploitation places to hide. Everything else in this course builds on those two ideas: what you are looking for, and where it is most likely to be.
The definition, in one paragraph The distinguishing features of modern slavery are coercion, deception and the loss of a real ability to leave. A worker who is underpaid but free to walk away and complain is being treated unlawfully and that matters in its own right, but a worker trapped by threats, manufactured debt, confiscated identity documents or deception is in a fundamentally more serious situation. In Australia, the underlying conduct — slavery, servitude, forced labour, debt bondage, deceptive recruiting and human trafficking — is criminalised at the Commonwealth level under the Criminal Code. The reporting obligations discussed later sit on top of that criminal law rather than replacing it. As an intermediate practitioner your job is not to prosecute a case; it is to recognise risk, ask sensible questions, and act proportionately.
