Residential building is regulated more tightly than ordinary contracting because it involves consumers — usually homeowners with no building expertise — entering the largest and most complex transaction of their lives with a professional builder, in circumstances where the consumer cannot readily judge quality, cannot easily undo a defective outcome, and stands to lose their home or savings if the builder fails. To correct this imbalance, every Australian state and territory has enacted specific home-building or domestic-building legislation that overlays ordinary contract law with licensing, mandatory contract requirements, statutory warranties, insurance and dedicated dispute pathways. The primary purpose of that legislation is consumer protection: to protect the homeowner, and in many respects subsequent owners of the home.
The ordinary law of contract, on its own, is a poor fit for home building. Contract law generally assumes two commercial parties of roughly equal bargaining power who can look after their own interests, read the fine print, and negotiate terms. A homeowner engaging a builder is nothing like that. They are typically a one-off consumer dealing with a repeat professional; they cannot inspect concealed work such as footings, waterproofing or structural framing once it is covered; and the consequences of a poor outcome — an unsafe or defective home, an unfinished project, or a builder who becomes insolvent partway through — are financially and personally devastating. Left to ordinary contract law, the risk would fall almost entirely on the least-informed and least-protected party.
