OVERVIEW

About this course.

Conveyancing is the legal process of transferring the ownership of real property — land, and the buildings on it — from one person to another, most commonly from a seller to a buyer in a sale. It covers everything from the preparation and signing of the contract of sale through to settlement, when the price is paid, the transfer is completed and the buyer becomes the new registered owner. Conveyancing matters because property is valuable, the interests involved are complex, and mistakes can be very costly and hard to undo. Getting it right protects both parties and gives the buyer secure, marketable ownership. This module explains the concept in general terms and is not legal advice.

The word "conveyancing" comes from "conveyance", the act of conveying or transferring an interest in land. In practice, conveyancing is the structured legal and administrative work that surrounds a property transaction: examining the seller's title, preparing or reviewing the contract, carrying out searches and enquiries, arranging the exchange of signed contracts, calculating the money that must change hands, and attending to settlement and the registration of the new ownership. It applies not only to straightforward house-and-land sales but also to units and apartments, vacant land, rural property and commercial property, and to some other dealings such as transfers between family members. Although the language and the mechanics can seem technical, the underlying purpose is simple: to move ownership safely and to make sure the buyer gets what they are paying for.
