OVERVIEW

About this course.

This course gives building and construction employers, supervisors and small-business owners a practical, plain-English understanding of how workers compensation and return to work operate in Australia, and of the part an employer plays in them. It explains the purpose of workers compensation as a no-fault scheme, and it is careful and repeated about a point that trips up many businesses: workers compensation is not harmonised across Australia. Unlike the model work health and safety (WHS) laws, which most jurisdictions have adopted from a national template, workers compensation is run separately by each state and territory under its own legislation, its own regulator or authority and its own insurance arrangements. What is true of the scheme in one state may be untrue next door. For that reason this course stays general: it describes how the process works in principle, names schemes only as examples, and sends you repeatedly to the authority in your own jurisdiction for the detail.

The course then works through the employer's practical role: what to do in the first hours after an injury, how the injury management and return-to-work process unfolds, who is responsible for what, and how suitable duties and a return-to-work plan fit together. Throughout, it keeps two separate but connected legal worlds in view — the WHS duties that are about preventing harm and are enforced by WHS regulators, and the workers compensation obligations that are about supporting a worker after harm has occurred and are administered by the workers compensation authority in each jurisdiction. It deliberately avoids stating specific dollar amounts, waiting periods, percentages or timeframes, because those are set differently in each scheme and change over time; instead it explains how the process works and tells you where to confirm the numbers that apply to you.
