This course examines workplace bullying through the lens of Australian work health and safety (WHS) law, where bullying is understood as a psychosocial hazard that a business must manage so far as is reasonably practicable. It sets out the widely accepted definition of workplace bullying, distinguishes bullying from behaviour that is not bullying, and explains the harm bullying causes to workers and to businesses. It then turns to prevention — the leadership, culture, consultation, training and work-design measures that reduce the risk — and to response, covering how to handle a report fairly, confidentially and promptly. Finally, it maps the main legal avenues available in Australia (the WHS pathway, the Fair Work Commission's stop-bullying jurisdiction, anti-discrimination law and workers' compensation for psychological injury) in general terms, and highlights how these differ by jurisdiction, using Victoria's separate occupational health and safety regime as the key example.
