What this course covers. Many building and construction practitioners have a solid working feel for site safety but a hazy picture of the law that sits behind it — where the rules come from, who makes them, who enforces them, and why the answer to "what does the law require?" so often begins with "it depends which state you are in". This course clears that fog. It is not a course about how to build a scaffold or manage a specific hazard; it is a course about the legal architecture of WHS in Australia, so that you can read your obligations correctly, find the right primary sources, and understand why a rule that applies in one jurisdiction may not apply in the same way in another.

The single most important idea in the whole course is this: Australia has a model WHS scheme, developed nationally, but there is no single national WHS law that governs every workplace. Safe Work Australia — a national policy body — develops model laws. It does not enforce them and it does not make them binding. Each state and territory then decides whether and how to enact those model laws, and each enforces its own version through its own regulator. The result is a system that is broadly harmonised but not identical . Two jurisdictions stand apart more visibly: Victoria never adopted the model WHS laws and continues under its own OHS Act 2004, enforced by WorkSafe Victoria, and Western Australia adopted the model laws more recently than the early-adopting eastern states. Because of all this, jurisdictional variation is not a footnote to Australian WHS law — it is a central feature of it, and it runs through every module of this course.
